The first lawsuit case you mentioned was a case happened in my hospital. It was mentioned by the program faculty during my residency orientation.
The second case is a true case as well. We had a two-hour discussion in one of my fellowship master degree classes. The professor is a national renowned clinician and epidemiologist was involved in this case.
Doctors often get caught with legal issues, and they don't know much about it. The program staff might have confused the resource of the money according to what you said. The money could have been out of the insurance's pocket, not the hospital, but it didn't make much difference to them. That's why some physicians do defensive medicine nowadays, which is a very bad practice.
I am impressed by you knowledge on medical lawsuits.
